Ziyadh Hoorzook granted bail

by Muskaan Ayesha

Ziyadh Hoorzook, who was arrested under controversial terror financing laws, has been granted bail after several weeks in custody. His legal team, led by attorney Yousha Tayob, argued that the case against him is built on weak and outdated evidence. The bail ruling marks a significant development in what has become a closely watched legal battle.

The magistrate’s decision to grant Hoorzook bail was influenced by the defense’s argument that there was no concrete evidence proving he was a flight risk or that he would interfere with witnesses.

Tayob highlighted that some of the allegations against Hoorzook were based on an advertisement that surfaced years after the alleged offense, raising concerns about the credibility of the charges.

As part of the conditions for his release, Hoorzook was required to pay R30 000, surrender his passport, and report to the police three times a week. These measures are meant to ensure compliance with ongoing legal proceedings while addressing concerns raised by the prosecution.

The case has now been postponed for further investigation, leading to questions about the efficiency of the prosecuting authority. Tayob expressed concerns over the state’s preparedness, indicating that the defense will continue to push for transparency and accountability in the proceedings.

Hoorzook’s time in custody has taken an emotional toll on him and his family. The uncertainty surrounding the case and prolonged detention have contributed to significant psychological stress. However, strong support from his family and community has played a crucial role in helping him navigate the ordeal.

One of the broader issues raised in this case is the possible political motivation behind the charges. “This case stinks of political interference…It’s not an independent NPA prosecution, it’s a persecution.” Tayob added.

He suggested that the selective application of terror-related laws disproportionately affects Muslim individuals. If true, this raises concerns about the fairness of the legal system and the potential for discrimination.

Beyond Hoorzook’s personal legal battle, this case has sparked discussions about civil rights and the use of terror financing laws. The outcome could set an important precedent for future cases, influencing legal discourse around the fair application of these laws.
